Terms of use

1. Provider and scope

The Mondstunde app is provided by Christian Kau, Brunnenstraße 121, 53332 Bornheim, Germany (see legal notice). These terms apply to the use of the app. Apple's standard license agreement for App Store apps also applies. Where they conflict, these terms take precedence to the extent Apple permits.

2. What the app does

Mondstunde uses artificial intelligence (AI) to create bedtime stories based on your input, can read them aloud with an AI voice and can continue them as a series. The app is meant for adults who read to children. Children should only use the app together with an adult. You must be of legal age or have your parents' consent to subscribe.

3. Free story and subscriptions

• Your first story is free. For more stories you need a subscription ("Family" or "Basic").
• Subscriptions are purchased and paid for exclusively through Apple's App Store. Apple is your contractual partner for payment, and Apple's terms apply. You see prices and durations in the app before you buy.
• New subscribers can try it free for 7 days if Apple shows this offer for your account. If you don't cancel at least 24 hours before the trial ends, the paid subscription starts.
• Subscriptions renew automatically for the chosen period (month or year) unless you cancel at least 24 hours before it ends. You can cancel anytime in your Apple account settings (Settings → your name → Subscriptions).
• Refunds are only possible through Apple (reportaproblem.apple.com). Your statutory rights remain unaffected.
• A subscription can be used on up to 5 devices signed in with the same Apple account.

4. Scope of service and fair use

• New stories: With a subscription you can create up to 35 new stories or continuations per calendar week (5 per day on average). This limit protects against abuse and is enough for normal family use. You can read and listen to finished stories as often as you like.
• AI voice: Family includes 200 minutes and Basic 30 minutes of AI voice within each 4-week period. Stories that were read aloud once are saved and cost no minutes when you listen again. Unused minutes expire. Reading yourself and the device voice are unlimited.
• Plan differences: Only Family includes the additional voices and your own story goals.
• New stories and the AI voice need an internet connection. We aim for high availability but cannot guarantee uninterrupted access, for example during maintenance or outages at our service providers.
• We may develop the app further and change features where this is reasonable for you and the core service (creating stories and reading them aloud) is preserved.

5. AI content

• Stories and the voice are generated automatically by AI (Google Gemini). Every story is checked automatically to be child-friendly before it is shown. It may still contain mistakes, inaccuracies or unsuitable passages. If in doubt, please read or listen to new stories yourself first and choose what you read to your child.
• The stories are entertainment. They do not replace educational, medical or therapeutic advice, and neither do the sleep exercises.
• If you notice an unsuitable story, please let us know via the contact form.

6. Your input

In free-text fields (your own theme, your own goal, names of other characters, your own idea) only enter what the story needs: no surnames, addresses, health details or other sensitive data, and no content that violates laws or the rights of others. We may refuse requests that are clearly abusive.

7. Rights to the stories

You may use the stories and audio created for you privately and free of charge, for example read them aloud, print them and share them within your family. Commercial use, such as selling them or publishing them for payment, is not permitted. The app itself, its design, texts and sounds remain our property or that of our licensors.

8. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are only liable if we breach an essential contractual obligation on whose fulfilment you may rely, and then limited to the foreseeable damage typical for this contract. Otherwise, liability is excluded.

9. Privacy

How we handle data is described in our privacy policy. In the app, Settings → Privacy → "Delete all data" removes all data on your device and our server at any time.

10. Changes to these terms

If we change these terms, we will inform you in the app in good time beforehand. Changes that put you at a significant disadvantage only apply to an ongoing subscription from its next renewal; you can cancel before then.

11. Final provisions

German law applies. If you are a consumer, the mandatory consumer protection rules of the country where you habitually reside also apply. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If any provision is invalid, the remaining provisions stay in effect.
